The West Virginia Supreme Court of Appeals, in a strongly worded decision by Justice McHugh, upheld the Union's win in a grievance affirming the right of public employees to withdraw a resignation tendered prior to its acceptance or final effective date. This decision confirms earlier rulings that a tenured public employee enjoys property rights in the matter of their employment, and can not be lightly deprived of that valuable service.
